General Terms and Conditions

1. Applicability

These terms and conditions apply to all offers, bookings, and agreements between DJ Grampa Kempa (the “Service Provider”) and the client (the “Client”), whether for live performances or the creation of personalized music.

2. Bookings and performance

  • Engagement: A booking is considered definitive only after written confirmation (email or signed contract).

  • Technical Requirements: The Client is responsible for providing a professional sound and light installation unless otherwise agreed in writing. The DJ booth must be stable, covered (if outdoors), and provided with a reliable power supply.

  • Cancellations:

    • Cancellations by the Client within 30 days of the event may incur a fee of 50% of the total price.

    • Cancellations within 7 days of the event require 100% payment of the agreed fee.

3. Personalized songs & music production

  • Commission: DJ Grampa Kempa creates personalized songs based on the specifications provided by the Client.

  • Delivery: Songs will be delivered in high-quality digital format (MP3) upon full payment.

  • Revisions: One round of minor adjustments is included in the initial price. Major changes or additional versions may incur extra costs.

  • No restitution: Because this is a product created to your specifications, there is no standard 14-day return policy.

4. Intellectual property & rights transfer

  • Live Performance: The Client is responsible for any Buma/Stemra (or local equivalent) performance rights fees required for the venue.

  • Personalized Songs: Upon full payment, DJ Grampa Kempa transfers the economic rights (copyright) of the specific personalized song to the Client.

    • The song is transferred royalty-free, meaning the Client may use, play, and distribute the song for personal or commercial use without further payment to DJ Grampa Kempa.

    • DJ Grampa Kempa retains the right to use snippets of the work for promotional purposes (e.g., portfolio or social media) unless otherwise agreed.

5. Payment terms

  • All invoices must be paid within 14 days of the invoice date, or prior to the event/delivery of the song, whichever comes first.

  • Late payments will be subject to a legal interest rate and potential collection costs

6. Liability

  • DJ Grampa Kempa is not liable for damage to the venue, guests, or equipment provided by third parties, except in cases of proven gross negligence.

  • In the event of illness or force majeure preventing a live performance, DJ Grampa Kempa will make a reasonable effort to find a replacement but cannot be held liable for further damages or costs.

7. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent court in the district where DJ Grampa Kempa’s organisation is registered.
